Terms of Service

1. The deal in one paragraph

Ark watches your AI conversations from inside your browser, warns you before private data leaks, monitors your public share links, and proves it daily. These Terms are the rules of that service. By creating an account or using Ark, you accept them.

2. The Service

Ark provides: (a) a browser extension that auto-redacts sensitive data and detects public share links on supported AI platforms; (b) a web dashboard with scores, reports, and team features; (c) indexing checks of public share links; and (d) paid plans (Pro, Team, Business, Enterprise, Enterprise+) as described on the pricing page. We may add or change features; we won't remove paid features mid-term without a refund of the unused period. How we handle data is defined by our Privacy Policy; business customers may also sign our Data Processing Agreement (GDPR Art. 28 / Singapore PDPA) — request it via support@arkprivate.com.

3. Your account

• You must be 16 or older and provide a real email address.
• You are responsible for your password and for activity under your account.
• One account per person for the Free plan. Team plans are per-seat.

4. Billing

• Paid plans are billed in advance via our payment processor, Airwallex. We never see or store your card number.
• Monthly plans renew each month; annual plans renew each year. You can cancel anytime — access continues to the end of the paid period.
• Refunds: if Ark simply doesn't work for you, email us within 14 days of your first payment for a full refund. Renewals are refundable within 7 days if unused.
• Prices can change with 30 days' notice; changes never apply to a period you've already paid for.

5. Free Month Challenge (launch promo)

• The first 100 registered users can unlock one free month of Ark Pro by inviting 2 friends via the in-product invite tool.
• An invite counts only if the friend registers within 24 hours of the invite being sent, using the invite code.
• Friends who register in time also receive one free Pro month.
• Free months carry no payment obligation and end automatically — no card required, no auto-conversion.
• One promo unlock per person. Self-invites, disposable emails, and scripted signups void eligibility; we may revoke promo access obtained by abuse.

6. Referral program

• Each paying conversion through your referral link earns you one free Pro month (stackable, up to 50 referrals per 90-day window).
• Referred customers receive 50% off their first month.
• Rewards are account credit only — not cash, not transferable. Abuse (self-referrals, fake accounts) voids rewards.

7. The $500 Leak Warranty

• Applies to active Pro and company-plan subscribers in good standing.
• Covers share links created on supported platforms while the Ark extension was installed and enabled in the same browser profile.
• "Failed to detect" means Ark showed no record of the link in your dashboard or alerts before you reported it.
• One claim per customer per 12-month period. Paid within 30 days of a validated claim, as cash or credit at your choice.
• Exclusions: content you intentionally published (blogs, public posts), links shared before you installed Ark, platforms not on our supported list, and accounts terminated for abuse.
• Claims: support@arkprivate.com with the link URL and your account email.

8. Acceptable use

• No attacking, probing, or load-testing our infrastructure; no scraping the API; no reselling access without written agreement.
• No using Ark to monitor other people's accounts without their knowledge and consent (team admins must have authority to enroll members).
• We may suspend accounts that violate these rules; serious abuse may be terminated without refund.

9. Intellectual property

• Ark — the extension, dashboard, API, brand, and content — is our property. Your subscription buys a license to use it, not ownership.
• No reverse engineering: you may not decompile, copy, resell, or build a competing service from Ark's code, detection patterns, or scoring methods, except where the law expressly allows it.
• Your data stays yours. We claim no rights over your conversations, your content, or your exported records.
• Feedback you send us may be used to improve the Service without compensation.

10. What Ark is not

• Ark reduces risk; it cannot guarantee that no leak will ever occur. Security is a process, and Ark is one strong layer of it.
• Ark is not legal, medical, or compliance advice. Compliance modes are assistive tooling, not certifications.
• Third-party AI platforms (ChatGPT, Claude, etc.) are run by their own operators under their own terms; we are not affiliated with them.

11. Liability

To the maximum extent permitted by law: (a) the Service is provided "as is"; (b) we are not liable for indirect or consequential damages; (c) our total liability is capped at the fees you paid in the 12 months before the claim — except the Leak Warranty in Section 7, which is honored as stated. Nothing in these Terms limits liability that cannot be limited by law.

12. Termination & data

You can leave anytime: cancel in one click, then purge your data from the dashboard (gone within 72 hours, including backups). We may terminate accounts for non-payment or abuse, with notice where practicable.

13. General

• These Terms are governed by the laws of Singapore; disputes go to the courts of Singapore.
• If a clause is unenforceable, the rest still apply.
• We may update these Terms with 30 days' notice by email and on this page; continued use after the notice period means acceptance.
